These Terms and Conditions apply to the use of our website and the purchase of products or services from Jobe Gas.
- ACCEPTANCE OF THESE TERMS
By using our website, placing an order, accepting a quotation, paying a deposit or booking a service, you confirm that you have read and accepted these Terms and Conditions.
Nothing in these terms is intended to exclude or limit any right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), the Protection of Personal Information Act 4 of 2013 (“POPIA”) or any other applicable South African law.
- PRODUCTS AND SERVICES
Jobe Gas supplies gas appliances, LPG equipment, accessories, cylinders and related products. We also provide LPG installations, repairs, servicing, inspections and related services.
Physical products, excluding LPG cylinders and other restricted goods, may be delivered throughout South Africa.
LPG installations are currently provided within KwaZulu-Natal, subject to availability, site conditions and an accepted quotation.
LPG cylinder delivery is limited to qualifying areas within Durban and normally takes place on weekdays, subject to stock, route capacity, access and safety requirements.
- PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, photographs, specifications and prices are accurate. Product images may be illustrative, and colours, packaging or minor specifications may differ from the images displayed.
Customers must confirm that a product is suitable for their intended application before ordering. Where professional installation is required, the product must be installed by a suitably authorised or competent person.
- PRICES
All prices are displayed in South African Rand.
Applicable taxes, delivery fees, installation costs and other charges will be disclosed at checkout, in the product listing or in a written quotation, where reasonably possible.
We may correct an obvious pricing, description or stock error before accepting or dispatching an order. If payment has already been made for an order affected by such an error, the customer may accept the corrected terms or cancel the affected order for a full refund.
- ORDERS AND PAYMENT
Placing an order constitutes an offer to purchase. An order is accepted once we issue confirmation, receive the required payment or begin fulfilling the order.
Products remain subject to stock availability. If an item becomes unavailable after payment, we will offer a suitable alternative, allow the customer to wait for stock or refund the amount paid for the unavailable item.
Online payments may be processed by independent payment service providers, including Ozow or other payment platforms made available on our website. Jobe Gas does not ordinarily receive or store customers’ complete banking login details or card information.
Ownership of products passes to the customer once full payment has been received. Risk in delivered products passes to the customer upon delivery to the nominated address or collection by the customer or the customer’s nominated carrier, subject to applicable law.
- QUOTATIONS
Unless otherwise stated, quotations are valid for the period shown on the quotation. If no validity period is shown, the quotation is valid for 14 calendar days.
A quotation is based on the information and site conditions disclosed to us. Additional work or materials required because of concealed services, unsafe conditions, inaccurate measurements, restricted access, pre-existing defects or previously undisclosed requirements will be explained and quoted for before the additional work proceeds.
We will not perform chargeable additional work without the customer’s approval, except where urgent work is reasonably necessary to make the installation safe.
- INSTALLATION BOOKINGS AND DEPOSITS
An installation date is only secured once the required deposit has been received and the booking has been confirmed by Jobe Gas.
The deposit may be used to purchase or reserve appliances, cylinders, cages, piping, fittings and other materials required for the installation.
A deposit is not automatically forfeited if the customer cancels. However, Jobe Gas may deduct a reasonable cancellation charge and any reasonable, demonstrable costs already incurred, including:
• specially ordered or non-returnable materials;
• supplier cancellation or restocking charges;
• completed design, inspection or preparation work;
• delivery, collection or travel costs already incurred; and
• reasonable losses resulting from a late cancellation.
Any refundable balance will be paid in accordance with our Refund and Cancellation Policy.
- INSTALLATION REQUIREMENTS
The customer must:
• provide accurate information about the premises and proposed installation;
• ensure lawful and safe access to the site;
• disclose known electrical, plumbing, structural or gas-related defects;
• ensure that an authorised adult is present where required;
• obtain landlord, body corporate, municipal, fire department or other approvals applicable to the premises; and
• ensure that the installation area is reasonably clear and ready for work.
Installation dates and completion times are estimates and may be affected by weather, traffic, supplier delays, unsafe conditions, emergencies, changes in scope or circumstances outside our reasonable control.
Jobe Gas may suspend or refuse work where site conditions are unlawful or unsafe.
- CERTIFICATES OF CONFORMITY
A Certificate of Conformity (“CoC”) will only be issued where the completed LPG installation complies with applicable legal and technical requirements and after all amounts due for the installation have been paid.
A CoC relates to the installation inspected or completed by Jobe Gas at the time of certification. Unauthorised alterations, tampering or later additions by another person may invalidate the certification or require a new inspection.
Where municipal, fire department, landlord or body corporate permissions are required, the customer remains responsible for obtaining them unless our written quotation expressly states otherwise.
- WARRANTIES AND QUALITY
Goods are supplied with the statutory warranties provided by South African law, including the CPA’s implied warranty of quality where applicable. Manufacturer warranties may provide additional protection.
Installation and repair services will be performed in a manner and quality that persons are generally entitled to expect, within the limits of the agreed scope of work.
A warranty does not cover damage caused by misuse, tampering, unauthorised installation or repair, incorrect gas supply or pressure, water damage, electrical surges, neglected maintenance, abnormal operating conditions, fair wear and tear or failure to follow the manufacturer’s instructions, except where the law provides otherwise.
- CANCELLATIONS AND RETURNS
Cancellations, returns and refunds are governed by our Refund and Cancellation Policy and Returns Policy. These policies form part of these Terms and Conditions.
Special-order or customised goods may not be cancellable merely because the customer has changed their mind, where the law permits this limitation.
Used or partially used LPG cannot ordinarily be returned merely because the customer has changed their mind. This does not remove any rights relating to LPG or a cylinder that is defective, unsafe, incorrectly supplied or otherwise protected by law.
- DELIVERY
Delivery is governed by our Shipping Policy, which forms part of these Terms and Conditions.
The customer is responsible for supplying a complete and accurate delivery address and ensuring that an authorised person is available to receive the order.
Additional delivery charges may apply where delivery fails because of incorrect information, restricted access, the absence of a recipient or another circumstance within the customer’s control.
- LPG CYLINDER SAFETY AND EXCHANGES
LPG cylinders are subject to strict safety and handling requirements.
Where a cylinder is supplied on an exchange basis, the customer must provide an eligible cylinder of the corresponding or accepted size and type. We may refuse to collect or exchange a cylinder that is unlawfully filled, severely damaged, unsafe, incompatible or otherwise unsuitable for exchange.
Customers must store, transport and use LPG cylinders in accordance with the manufacturer’s instructions and applicable safety requirements. LPG cylinders must not be tampered with, modified, overfilled or transferred between cylinders by an unauthorised person.
- LIMITATION OF LIABILITY
Jobe Gas remains responsible for loss or damage caused by our negligence, defective goods or services, or any other matter for which liability cannot lawfully be excluded.
To the extent permitted by law, we are not responsible for indirect loss caused by circumstances outside our reasonable control, customer-supplied equipment, unauthorised work, inaccurate information provided by the customer or failure to follow safety and operating instructions.
Nothing in this clause excludes any consumer right or remedy under the CPA or other applicable law.
- WEBSITE USE
Website content may not be copied, reproduced, republished or commercially exploited without our written permission, except where permitted by law.
Users may not introduce malicious software, interfere with the website, attempt unauthorised access or use the website for unlawful or fraudulent purposes.
- PERSONAL INFORMATION
Personal information is processed in accordance with our Privacy and POPIA Policy.
- COMPLAINTS
Complaints should be sent to:
Email: info@jobegas.co.za
Telephone: 063 351 3573
Please include your name, order or quotation number, description of the issue and relevant photographs or supporting documents.
We will endeavour to acknowledge and resolve complaints within a reasonable period. Customers retain the right to approach an appropriate consumer protection authority or ombud where a complaint cannot be resolved directly.
- GOVERNING LAW
These Terms and Conditions are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a court, tribunal, ombud or consumer protection body having lawful jurisdiction.
- CHANGES TO THESE TERMS
We may update these Terms and Conditions when our operations, website or legal obligations change. The version applicable to an order will generally be the version published or provided when the order was placed, unless the law requires otherwise.
